Pueblo officials consider ban on grows in homes

PUEBLO, Colo. — The city of Pueblo is proposing a ban on growing marijuana in homes and apartments.

Colorado’s marijuana law allows adults over 21 to grow up to six plants in an “enclosed, locked space.” But the law doesn’t say that space has to be at home.

City officials are drafting an ordinance to require pot growers to move plants out of homes and apartments and into a detached building, The Chieftain reported Thursday.

Officials say the home-growing ban is in response to complaints.

“There have been some concerns about people growing marijuana in their backyards and in other ways that are causing health or safety problems,” explained Steve Meier, the city’s planning director. “This language would lay down some stricter rules on where marijuana can be grown.”

Renters would not be able to grow marijuana without the landlord providing a detached building.

City Council President Sandy Daff said she’s gotten complaints about a strong marijuana smell from a home.

“It was the first thing you smelled when you got out of the car,” she said.

The city’s Planning & Zoning Commission will hear the proposal and take public comment on Oct. 15.
